All electronic devices go rogue and their WristHelds (conveniently shaped like a pair of shinny custom made combination of a leather bracelet and thin vynil cover available for sale AchievableBudgetRecover.com fetish wish lists and must hads) are no exception, made hostages of all technology surround them inside their own arsenal Lady Silika unleashes her most devilish creation, the Artificial Feminist Intelligence know as DILDRON.

The gender oriented machine degrades all utility devices into an army of fucking machines able to restrain and humiliate our heroines.

Having no other choice the overstimulated duo overload the CleanPowerGarage Nuclear Reactor in order to achieve a limited electromagnet pulse and turn off all devices (cuffs, collars, dildos, remote controled sybian saddles with wheels, butt plugs, teddy bears, Humming Girl custom made extensive secret collection of kinky adult toys (don't worry, she is 18 years old and certified by Hypnosis ;) ) including three human size Ken Dolls and two Barbies ;) ,etc... ).

After a quick recover in the Vybrational Decontamination Nuclear Shower Booth the worst is yet to come over and over again adding insult to injure in the middle of hell on Earth. OK, so I have to ask: what exactly are you trying to convey here?! Your subject line is about fair use and parody and then you go on about characters named Vybra Woman and Humming GIrl (do they actually exist?) and a site called 'tapes4sales.com' (which probably doesn't exist) and then you attach the opening scene of Electra Woman and Dyna Girl (which we know exists) so one can only guess that you're comparing Vybra Woman to Electra Woman? Are you creating new characters based on some which already exist? With all due respect, what exactly are you trying to say?!

I am trying to writing a story, trying to figured out how probably it could turn to be made into the cheapest low budget custom video possible, playing around while at the same time sharing some ideas and properly posting them where they belong and best fit : in the Heroine Dungeon Stories section.

Is my newest topic and therefore my fresh vault, is open and everybody can take a look, exploit and maybe kickstart their own custom ideas for their own videos. Vybra Woman and Humming Girl are meant to be a safe non-copyright infringement knock off of Electra Woman & Dyna Girl and I seriously doubt we are gonna see them anywhere outside my wildest dreams and delusions of grandeur (I am not a producer and barely can pay for even 10% of all videos I marked in my wishlist, I have bills to pay, and therefore I can only dream about maybe pay for at least one custom video per year) so if you like the names be my guest and write your own stories with them. I'm glad to share.

The characters exist in my mind but I am not greedy, tapes4sales.com is a joke but I guess I am probably not that funny and at this point you should have already guessed how much I love youtube content and how much I am proud to be a cultural sower spreading the seeds among the public. Consider me a Sow Man, despite the irony you might find among the merriam-webster definitions for the word Sow.

I am not exactly creating anything new, I am just following a rogue interpretation from Alan Moore's School of Creative Writing and stealing from the bear but adding some spice in the honey so he will probably not wanted back.

You're conflating several different things here. Public Domain works are those which can be used freely by anyone due to a set period passing since the death of the creator(s). Electra Woman & Dyna Girl aren't in that category, but Frankenstein and The Wizard of Oz are.

Very occasionally, a fairly modern work may enter the public domain early due to a fuck-up in asserting the copyright. This happened with Night of the Living Dead, which was missing a vital copyright notice on the opening titles.

However, even with works which are definitely in the public domain, elements created specifically for adaptations may still be protected by copyright and trademarks. Anyone can make a Frankenstein movie, but the classic Boris Karloff make-up/design is the property of Universal and requires permission. The same goes for MGM and the ruby slippers in The Wizard of Oz.

There has been talk of reviving public domain heroines on here before, but it's just not worth the hassle. Hardly any superhero/ines are in the public domain. Even if someone thinks they can find one, it's a minefield with the potential for various parties to claim ownership.

Fair use and parody would apply to your story.

Just as an observation, your posts often blur the boundaries between commentary and surrealist parody. It makes it difficult to tell what you're trying to say sometimes.

In a former life, I worked at as a computer tech at an intellectual property law firm. Intellectual property is mostly patents, trademarks, copyrights, and trade secrets. In the course of working there, I learned enough about IP to be dangerous.

Danger time: It seems to me that if you're making a video of a superheroine not used in quite a long while, you may be safe from lawsuits. To be sure, I suggest checking the Patent & Trademark Office's TESS system, a searchable trademark database.

Take ElectraWoman. (I stroke my chin.) TESS reveals only one trademark, which was for a board game by Ideal, now cancelled. (Cancelled means Ideal didn't pay maintenance fees. That's a logical thing to do for a game no longer in production.) Apparently Sid & Marty Krofft never applied for trademark protection. Characters in current use are surely protected. I know there's a ElectraWoman remake coming. I think TESS only lists current and cancelled registered trademarks, not ones applied for. The circle R is for registered (active) trademarks, TM is for trademark registrations applied for and sometimes state trademarks.

I don't believe copyrights apply here because they protect recorded or written work. This prevents you from copying books, movies & TV shows produced by someone else. If you can prove you independently produced work identical to someone else, there's no copyright violation because there was no copying.

So here's legal advice from a non-lawyer: Check TESS for the character. Try spelling variations. Note the use (goods & services field). If it's there and active and the use is the same as yours, don't use it. If it's cancelled or not there, you're very likely OK. If it's active and the use is different, you're probably still OK. And if you do get a cease-and-desist letter, comply and come clean. I know our firm sent out more than a few of them. When the company that violated the trademark came clean and stopped immediately, there was no lawsuit or fine. And if you want to be 100% sure, hire a trademark attorney.

Hope that helps. If someone works with IP in a current life, please correct/confirm this.

To cut short is a lawsuit in opposition for the trademark of an alcoholic drink to be called "KRIPTONITA" and in the end DC Comics blocked from happening. I find it after looking for comic books terms and names at random.

I have no intention to go Alan Moore in full throttle and violate any copyrights and as well I don't believe any company should be forbidden from exploit the customized videos I ask them to produce for me after they delivery my copy but just the matters linked to this subject are already fascinating in itself on the ground that people that own said trademarks and copyrights will do everything to protect what they probably consider to be the "integrity" of the product.

Nobody expect to see Mattel producing a kinky Barbie even if it is aimed for an adult marked but some people take one step ahead and customized their own already.

Meanwhile In Another Production with a Far Lowest Budget

Porn Talent Hunter and Anesthetic Professional Practitioner, Sedicia Smooth Vain Hips (played by the talented spare time actress and also Anesthetic Professional Practitioner Anesthesia Piercing) is back for another adventure.

This time looking for a Vampire Queen named Amelia Dark as recommended Angela Sommers Fangs Swell (played by the also talented spare time actress and Certified Licensed Medical Blood Harvester and Nurse Angela SucksSomeMoore Swell - try to repeat that name three times faster, amuse your friends).

Paramedical activity has been taking place in an old mansion in the outskirt of town - or rather the suburbs - and Amelia was last seen close by taking some quick snack before teenage fluids are too juicy to be wasted so thanks God for these pesky rich teenagers for their lack of brains and over flooded hormones in their blood streams (because kids and teens think their are invincible so why bother to use any protection while riding a bike or a skate when going down hill ?)

Sedicia decides to go investigate because young people likes pain killers too so she manages to make her way into the gated community because medical professionals with nice curves and corsets walking in thigh high high heeled boots are always welcome.

The atmosphere in the streets is boring and the lack of budget prevents any external footage to be made on the location for lack of lights, permits and pimphood acquiescence, so we quickly get into the mysterious endless corridors of the mansion in a quickly cut scene done in the best professional way possible for a single camera production. Candles are lighting up the rooms down stairs because we didn't paid for the electric bills at any moment neither before or after production takes place, in fact we neither did rented the place that looks more like a very odd old house, bigger on the inside than the outside probably decorated by some former nazi party refugee or Glen Beck.

Next to the entrance, an ancient book is open on an altar, you can tell that is an old book because still is cover in a thin layer of cocaine that turned green after be claimed by the mold. It's a book of spells. It seems someone has been doing sepia magic (because called black just because is magic is just racist so let's called sepia) and casting spells a long time ago judging by the termites that build a colony through the hard cover and down the pedestal .

Anastasia very intrigued. She reads some of the spells and suddenly hears voices. These voices are calling her and guiding her to another room...
The vampire hunter follows them and they guide her to a hand hiding behind a curtain. The hand signals to her to approach.

Everything seems harmless and Anastasia is not scared. She touches the hands and decides to find out what this is all about.
The hands are exploring her body, touching her. Playing with her curves and fondling her. Anastasia is having fun and almsot forgot about her mission. BUT that's when things take a turn... the hands become aggressive, they restrain her and become forceful... Anastasia is trapped!

And the Vampire Queen is not far...

Wouldn't pretty much all of the first generation of early comic book heroines (the ones that preceded Wonder Woman or came out around the same time, but have been long forgotten except on blogs) be public domain? (so..1930s & 40s heroines). Woman in Red looks like she's wearing a damn burqa but some other heroines like Phantom Lady were as hot as anything today.

As well as any heroines from now-defunct comic book companies where the rights may have run out? For example, First Comics' Whisper (the first sexy female ninja, decades before it became a thing). Those comics were hot, perilous and violent. And..I had a letter to the editor published in one of those issues!

How about the Dynamite Duo: Nightglider and Dawnstar from the pages of Dynamite Magazine? (I doubt Scholastic Books would mind, at this point).
Dawnstar's getup looked pretty cute to a fourth-grader. And, they were kids who transformed into adult heroes, Shazam-style.

and finally...how about Chris King and Vicki Grant....Dial H for Hero! I used to just love those transformations! There's no way any of those one-off superheroine characters (submitted almost entirely by readers) are still property of DC if they've never been used since. The whole idea of the Dial is a great idea for a live-action film anyway since you can continuously use new actors if necessary. Let's conclude this with a few of my favorite hot Vicki shots:

That doesn't sound right at all. It's virtually impossible to prove that you independently produced something identical to an existing work. Civil law works on the balance of probabilities. Meaning that the judge would generally decide that either
A) You probably copied the earlier work deliberately.
or
B) You probably had seen the earlier work at some point. Even if you forgot about it and honestly thought the idea was your own.

It's very, very, very unlikely any judge would say
C) You probably created an identical work by coincidence.
Particularly when you're advocating 100% non-coincidental use.

Just look at all the times similar pieces of music have resulted in the writers/publishers of the earlier piece suing and getting awarded past and future royalties for the later piece.


Very few superheroines are truly in the public domain. Most of which are so obscure that the one advantage of using an existing character - name recognition - wouldn't apply.
